MATTEL, S.A. (hereinafter “MATTEL”), with registered office in C/Aribau, number 200, Barcelona, with tax ID code A-08842809 and owner of the BARBIE brand, is organising the second “Tú Puedes Ser Lo Que Quieras” (the “Competition”), which is governed by the following rules (the “Rules”).
The Competition aims to halt gender stereotyping and promote equality in schools.
The objectives are:
The competition is aimed at Primary Education students (1st, 2nd, 3rd, 4th, 5th and 6th years) at all state schools.
The registration in the competition will be managed by the teacher of each class that takes part in accordance with the provisions contained in clause 4.
The competition will start on 16 September 2019, the date on which the registration period starts.
Registration and receipt of work shall take place from 16 September 2019 until 30 April 2020, both inclusive.
The competition will end in May 2020, when the winners are announced on the competition website: www.programaescolartupuedesser.es.
MATTEL reserves the right to extend the deadline for registration and receipt of jobs if it deems it necessary or desirable, as described in clause 10.
Participation in the Contest will require the express acceptance of the Rules published on the competition website (www.programaescolartupuedesser.es).
MATTEL reserves the right to disqualify participants who do not comply with the rules and participation in breach of the rules.
By accepting these Rules, participants declare that they understand the terms and conditions of the same and undertake to comply with the applicable law, so that by merely participating in the contest you give your consent to be bound by the Rules and the law fully and irrevocably.
If the participant indicates otherwise at any time, he or she will be excluded from the Competition, releasing MATTEL from all or any commitments to the participant.
Participation in the competition is completely free of charge. Participating teachers must comply with the following requirements:

You may also register free of charge by calling the free helpline on 900670201, although you must still consent to the above-mentioned legal texts on the website.
At the end of the enrolment process, each participating teacher will receive a username and password to access their private area (Private").
Each participating teacher may enrol one or several classes, each of which will submit its work. Only one piece of work will be accepted per class.
Via the Private Teacher Area, submit one project per classroom online (one project, one classroom) in accordance with the requirements detailed in clause 5, in category A or B, depending on the school year of the participating classroom within the registration and submission period set out in clause 2. As an exception, projects will be accepted from students in both categories, both at grouped rural schools, and in itinerant circus classrooms, as well as any other type with similar characteristics.
All registered classes may take part, regardless of the category of participation, with the following two (2) formats:

Regardless of the format chosen, the participating teacher may upload the work from the Private Zone, with the poster or video, a PDF file with a maximum of two sides, explaining why these four women were chosen, their importance and contribution to society. Mere fame is not enough, so they must also describe the work done by the participating class.
In addition, students will be able to use all available techniques, which may be traditional, such as collage (using glue and scissors), or innovative using, for example, a computer program for processing images and videos (Photoshop, online editors, etc.).
If the group-class makes a poster, an illustration or a traditional collage, the teacher must scan or photograph on the work and upload the resulting file to the teacher’s Private Zone .jpg format. The file must be no larger than 2MB. The poster must have a title which may not exceed 140 characters, and it must be uploaded to the teacher’s private area.
If the group-class makes a video, the teacher should ensure that it is in .mp4 format that it is no longer than one minute long and that it explains the work done by the participating class. The video must not contain images where minors are recognisable. The video must have a title which may not exceed 140 characters, and it must be uploaded to the teacher’s private area.
Under no circumstances will MATTEL will be responsible for the content of the work submitted to the competition, responsibility for which lies entirely with participants with total indemnity for MATTEL.
Head teachers and teachers at state schools will be provided with a competition website containing educational material (about each of the areas: politics, culture, sports and science) which may be used in class to support the creation of the poster or video.
The jury will be composed of at least six (6) members: three (3) representatives of Mattel and three (3) persons specialised in the fields of communication, gender equality and education, respectively (hereinafter, the "Jury").
The Jury will make an initial selection best works and then will make select the two (2) winners, one in category A (1st, 2nd, 3rd primary education) and education) and another in category B (4th, 5th and 6th primary education).
The jury will evaluate these aspects for all the projects submitted:
All work not submitted in required formats as established in these rules will be declared null and voice and will be excluded from the competition, as will those which are incompatible or which breach copyright.
Once the winning work has been selected, it will be published on the competition website (www.programaescolartupuedesser.es) in June 2020.
Participation can be in one of these two categories:
Two (2) winning classes will be selected, one per category. Each will receive an experience consisting of a group activity worth FIVE HUNDRED EUROS (€500) (including VAT). The prize may not be exchanged for cash.
The physical media and rights over the work shall become the property of MATTEL, which may request the submission of the original of any work submitted, which it will be under no obligation to return.
With respect to intellectual property right, participants transfer this to MATTEL for a period of 50 years, without territorial nor material limit, and with the possibility to transfer all or part of the property rights transferred to third parties of as well as rights of reproduction, on paper or the internet, exhibition, compilation, public communication and exploitation on the work
MATTEL reserves the right to process, adapt, modify and correct the winning work without restriction to adapt it for promotion and dissemination of the competition and its results.
In accordance with Regulation (EU) No 2016/679 of the European Parliament and of the Council of 27 April 2016, the Protection of Personal Data, and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Security of Digital Rights, participating teachers are hereby informed that their data will be processed by MATTEL ESPAÑA, S.A. (whose address is in C/ Aribau, 200, 9th floor, 08036 Barcelona) for the sole purpose of managing the participation of classes in this competition.
The recipient of the information provided by the participants of this contest is MATTEL, which vouches that personal data will not be disclosed to any third party, except to collaborating agents acting on their behalf for the proper operation of the Competition and distributing the prizes.
The participant’s personal information to be processed by MATTEL will be your name and surnames, the School and class or classes represented, the email address and all the information which, according to the user privacy settings, are provided by participants in the Competition. Additionally, MATTEL may request more information from participants, such as the full address, telephone number, personal identification number and any other information that is needed to ensure proper participation in the competition, including delivery and acceptance of the prize on behalf of the winning class. Participants in the Competition guarantee to MATTEL that all personal information requested and provided a posteriori will be true and accurate.
MATTEL will retain participating teachers’ personal data for as long as is necessary to manage their participation in the competition and to contact in case of the class represented.
Persons who submit their data, guarantee that they are of legal age, may exercise their rights to access, rectify, delete, limit processing, portability, and opposition, by sending a written notice to MATTEL ESPAÑA, S.A., C/ Aribau, 200, 10th floor, 08036 Barcelona.
MATTEL warrants that it has implemented the necessary technical and organisational measures to control and maintain the integrity, availability and confidentiality of personal information provided by the participants.
MATTEL reserves the right to make changes or add appendices to these Rules in relation to its mechanics and the prize, provided that these changes are justified and are not detrimental to participants, are made during the competition period and that these are duly notified.
MATTEL accepts no liability if due to unforeseen circumstances or force majeure, the Competition cannot be held in any of its terms specified in these Rules, with no additional obligation on Mattel. In such a case, Mattel may opt for the publication of a new mechanical by the same means for the initial dissemination of the Contest or the annulment of the same, without any type of responsibility for Mattel. In addition, MATTEL will not be liable for the malfunctioning on the website.
If any provision of these Terms and Conditions is declared partially or totally void or unenforceable, this will affect only the Clause or part of the same which is considered to be void or unenforceable and the remainder of the rules will not be affected, unless they are a condition precedent and affect all the terms and conditions.
These rules shall be interpreted and governed in accordance with Spanish law. For any litigious question arising from the existence, access, use or content of the Rules, the participating teacher and MATTEL expressly waive any other jurisdiction, submitting to the jurisdiction and competence of the Courts of Barcelona.
